What Cases Typically Recover

Typical Compensation Ranges
in Ontario

These ranges reflect what Ontario settlements and court awards have generally produced for similar matters. Every case turns on its own facts — these figures are for general education only.

Motor Vehicle Accidents

Tort + Accident Benefits

Soft-tissue injuries with full recovery typically settle for $20,000–$60,000 above no-fault benefits. Serious orthopaedic injuries or chronic pain run $100,000–$500,000. Catastrophic designations (severe brain injury, paraplegia, multiple amputations) regularly exceed $1M, with accident-benefits caps of $1M (medical/rehab) and $1M (attendant care) on top of tort recovery. The $45,000 statutory deductible applies to general damages awards under Ontario's Insurance Act unless the award exceeds $150,000. Learn more →

Slip and Fall

Occupiers' Liability Act

Minor injuries with full recovery: $15,000–$50,000. Wrist, hip, or shoulder fractures requiring surgery: $75,000–$250,000. Permanent mobility loss or chronic pain in elderly claimants: $200,000–$750,000+. Municipal slip-and-fall claims require 10-day written notice and shorter limitation periods. Learn more →

Long-Term Disability Denials

Lump-sum settlement

LTD lump-sum settlements typically resolve at 60–80% of remaining benefit value when there are several years of benefits left, dropping toward 40–60% as the benefit period nears its end. Adding bad-faith damages (set out in Whiten v Pilot Insurance, 2002 SCC) can push recovery significantly higher where the insurer's denial conduct was egregious. Learn more →

Wrongful Dismissal / Severance

Common law notice

Common-law notice ranges from 2–24 months of total compensation depending on age, tenure, position, and the availability of comparable employment (the Bardal factors). Senior executives in specialized roles routinely receive 18–24+ months. Employment Standards Act minimums (1–8 weeks) are almost always lower than the common-law entitlement. Learn more →

Dog Bite / Animal Attack

Dog Owners' Liability Act

Minor bites with brief recovery: $10,000–$30,000. Bites requiring surgical repair or leaving permanent scarring: $40,000–$150,000. Disfiguring injuries to children or attacks causing PTSD: $150,000–$500,000+. Ontario's DOLA imposes strict liability on dog owners — no "one-bite rule." Learn more →

Wrongful Death (Family Law Act)

FLA s.61 + dependency

FLA non-pecuniary awards for loss of guidance, care, and companionship typically range $20,000–$50,000 per surviving family member, with higher awards for surviving spouses and young children. Pecuniary loss (lost income support, loss of services) often dwarfs non-pecuniary awards in cases involving working-age decedents — frequently $500,000–$2M+ in present-value terms.
